Q1: What if my site location (where I perform my job duties) changes?

  • Submit an updated I-983* with new signatures, listing the new location.

Q2: What if the address of my company's home office or headquarters changes?

  • Submit an updated I-983 with new signatures, listing the new location.

Q3: What if my position title changes?

  • IF the change in position title is linked to a material change to the Training Plan as described in Section 5 of the previously-submitted Form I-983, you must submit an updated I-983* with new signatures as well as a new Employer Memorandum of Understanding. In your email, be sure to indicate the effective date of your new position title.

  • IF the change in position title IS NOT linked to a material change to the Training Plan as described in Section 5 of the previously-submitted Form I-983, you only need to submit a new Employer Memorandum of Understanding. In your email, be sure to indicate the effective date of your new position title.

Q4: What if my job description changes?

  • IF it means that there has been a material change to the Training Plan as described in Section 5 of the previously-submitted Form I-983, you must submit an updated I-983 with new signatures.

Q5: What if my salary changes?

  • If your salary increases, you are required to submit an updated I-983* with new signatures IF the incrase in pay is a result of a change in your employment that would be considered a material change to the most recently submitted Training Plan (Form I-983, Section 5).

  • If, however, your salary increases for some other reason (such as an annual cost of living increase) that does not cause a material change to your Training Plan, you do not need to submit an updated Form I-983. 

  • If your salary decreases, submit an updated I-983 with new signatures.

Q6: What if the number of hours I work per week changes?

  • IF the number of hours you work increases or decreases, submit an updated I-983* with new signatures.

Q7: What if my supervisor (company official in I-983 Section 5) changes?

  • IF the official’s information in Section 5 is no longer accurate, submit an updated I-983* with new signatures.

Q8: What if my employer’s EIN (Employer ID Number) changes?

  • IF it changed because of a change in the employer’s ownership or structure, such as a corporate restructuring, submit an updated I-983 with new signatures.

Q9: What if my employer is bought by or merges with another company?

Q11: What if My employer assigns me to work at a client’s location?

  • Please note: USCIS updated their website in January 2018 to indicate a much stricter interpretation of the STEM OPT final rule regarding third party placements. While this website update does not constitute a regulatory change, it is something to consider when selecting an employer. It is unknown if this interpretation of the STEM OPT rule is shared by other immigration agencies such as Immigration and Customs Enforcement (ICE) and Student and Exchange Visitor Programs (SEVP) and how this interpretation will impact students in the future. We recommend that students filing for or with STEM OPT authorization follow the guidance as closely as possible (for example, working at the employer’s location rather than at a client site), but if that is not possible, the best you can do is to document the legitimacy of your training experience and relationship with your employer.
  • Keep in mind that if this site location is different that the site location reported on your most recently submitted Form I-983, you will need to submit a new Form I-983 to iss@wichita.edu
