As part of the online application and agreement for the food truck plaza, you will read and agree to the following terms and conditions.


WSU Food Truck Plaza Terms and Conditions

The following Terms and Conditions govern the operation of food trucks on the campus of Wichita State University including, but not limited to, the Food Truck Plaza ("Plaza"). Failure to abide by these Terms and Conditions or any other applicable statute, regulation, ordinance, or WSU policy may result in temporary or permanent removal of a food truck from the WSU campus.

  1. WSU reserves the right to remove and/or prohibit access to Food Truck Vendors ("Vendors") at any time and for any reason if the University deems such removal and/or prohibition to be in the best interest of the University.
  2. Vendors must submit the Food Truck Vendor Application prior to operating on the WSU campus. A copy of this Application can be obtained from the Director.
  3. Hours of Plaza Operation are published on the WSU Food Truck website, but are generally Monday thru Friday as follows (hours subject to change at WSU's sole discretion):
    1. Breakfast: 7:00am – 9:30am
    2. Lunch: 11:00am – 1:30pm
    3. Coffee Break: 3:00pm-5:00pm
    4. Dinner: starts at 6:00pm-8:00pm
  4. Vendors may make reservations for the Plaza by contacting the WSU Special Projects manager. Monthly schedules are finalized no later than one (1) week prior to the start of the month. Vendors must notify the Director as soon as possible of any last-minute scheduling changes. Vendors are advised that consistent and multiple requests for last minute scheduling changes may result in reduced scheduling opportunities.
  5. Operation of food trucks on the WSU campus but not within the Plaza requires University approval in each instance. Vendors should contact the Director for additional information and for scheduling availability.
  6. Upon approval of Vendor's reservation for the Plaza, Vendor will be assigned a parking stall at the Plaza. Parking is only permitted in the assigned parking stall.
  7. For operation at the Plaza, if the food truck is on a trailer and towed by a personal vehicle that does not fit within the assigned stall, Vendors must park their personal vehicle in WSU Parking Lot 27.
  8. Vendor must secure and pass all appropriate licensing requirements including, but not limited to (a) a valid City of Wichita Vendor license, (b) a valid State of Kansas Driver's License, and (c) appropriate food handler's permits prior to operating on the WSU campus. Vendor shall attach copies of said licenses and/or permits to its Application and must maintain a current copy on file with the University. The University reserves the right to terminate Vendor's reservation and/or future use of the Plaza for Vendor's failure to secure and maintain proper licenses and/or permits.
  9. Vendor's employees and agents must have the required training and/or required food handling licensing. Proof of such required training must be on file with the University. The University reserves the right to terminate Vendor's reservation and/or future use of the Plaza for Vendor's failure to secure and maintain proper food handling training and/or licensing.
  10. Vendors may arrive no earlier than three (3) hours prior to their reservation time unless otherwise authorized by WSU in writing.
  11. Vendor must adhere to all applicable state and local statutes, regulations, ordinances, and rules, including WSU policies and these Terms and Conditions, at all times. Violations of any such statutes, regulations,ordinances, rules, or policies, or these Terms and Conditions, may result in cancellation of any current reservation and/or denial of approval for future reservations.
  12. All University property is expected to be left in the same condition as it was received. Vendors must leave the Plaza (or applicable area(s) of operation) and surrounding area(s) free of trash and debris. Vendors are responsible for emptying all trash and recycling bin liners, replacing the WSU-provided liners in the bins, and leaving the bags at the north end of the Plaza or other designated points for pickup by WSU Physical Plant. Failure to do so may result in a cleaning fee assessed by the University.
  13. Vendor assumes responsibility for any damage caused to any University location and/or property by Vendor's patrons. Reimbursement costs for damages will be solely determined by the University.
  14. Vendor shall be responsible for either the repair or cost of repair to any University property, equipment, tools or furnishings damaged by Vendor or Vendor's employees, agents or patrons.
  15. All decorations, including signage, are strictly prohibited. Violation of this policy will result in a removal fee being charged to Vendor. Portable folding chalkboard-type signs that list menus or daily specials are exempt. Folding signage can only be placed on the sidewalk in front of your food truck.
  16. WSU is committed to providing a tobacco-free environment for its faculty, staff, students and visitors. Accordingly, WSU has adopted a smoke and tobacco free policy for all indoor and outdoor spaces. The unlawful possession, use, distribution, dispensation, or sale of tobacco products is strictly prohibited.
  17. The sale and/or service of alcoholic beverages is strictly prohibited unless otherwise authorized by the University in each instance.
  18. The use of external equipment, including but not limited to generators, is strictly prohibited unless otherwise authorized by the University in each instance. All equipment must be contained within or on the food truck at all times and must be properly enclosed.
  19. Food trucks must maintain a state of mobile readiness at all times. The appropriate health authority(ies) may prohibit alteration, removal, attachment, placement or change in, under, or upon the food truck that would prevent or otherwise reduce ready mobility. Food trailers that have been unhooked from the towing vehicle are considered to be in a state of mobile readiness so long as the towing vehicle remains reasonably close by and the trailer is in working order for towing (no flat tires, etc).
  20. Permanent utilities (e.g., plumbing, gas, electrical, water) may not be attached to the food truck at any time. At no time during operation is the food truck to be attached to a water hose or any other permanent water supply.
  21. Vendor must procure and maintain, at Vendor's expense, the insurance and bonds described herein. Insurance and bonds must be with a company or companies qualified to do business in Kansas, as acceptable to WSU, and written on the standard approved certification forms. Vendor must furnish a certificate showing proof of such insurance upon at the time of filings its Application and no less than annually thereafter. All liability insurance policies will name Wichita State University and Wichita State Innovation Alliance, Inc. as additional insureds with respect to claims, demands, suits, judgments, costs, charges, and expenses arising out of, or in connection with, any loss, damage, or injury resulting from the negligence or other fault of Vendor, its agents, representatives, and employees. Vendor must furnish certificates of insurance to WSU in the following minimum limits prior to participation at the Plaza:
    1. Comprehensive General Liability Insurance. Vendor shall maintain comprehensive general liability insurance with limits not less than $500,000 for each occurrence involving bodily injury and property damage, a general aggregate of $1 million, and products-completed operation aggregate of $1 million. Such coverage must include: premises operations broad form property damage, completed operations,independent contractors, and contractual and products liability.
    2. Comprehensive Automobile Liability Insurance. Vendor shall maintain comprehensive automobile liability insurance with limits not less than $500,000 for bodily injury and property damage combined, and must cover all owned, non-owned or hired vehicles of Vendor.
    3. Worker's Compensation Insurance. Vendor shall maintain worker's compensation insurance as required by Kansas law.
  22. Vendors accepting payment via credit card must be compliant with Payment Card Industry – Data Security Standards (PCI-DSS). Vendors must provide the Director with proof of compliance upon submission of the Application and at any time, upon request. Vendors must also read and sign the "Acceptance of Credit Card Payment by Non-WSU Merchants Form," which is part of the Food Truck Plaza Application.   23. Neither the University nor its employees or agents shall be liable for any damage to any personal property or to property entrusted to the University, its employees or agents, nor for the loss or damage to any property by theft or otherwise, by any means whatsoever. University shall not be liable for any injury or damage to persons or property resulting from fire, explosion, steam, gas, electricity, water or rain leakage, or any other cause whatsoever.
  24. The University makes no guarantees regarding minimum sales.
  25. Vendor agrees to indemnify and hold harmless Wichita State University, its officers, employees and agents,against all claims, demands, causes of action, suits and judgment, including expenses arising from any accidents, injury or damage caused to any person or property arising from Vendor's use of the Plaza. Vendor further agrees to indemnify and hold harmless Wichita State University Innovation Alliance Inc., its officers,employees and agents, against all claims, demands, causes of action, suits and judgment, including expenses arising from any accidents, injury or damage caused to any person or property arising from Vendor's use of the Plaza.
